1. 本ポリシーについて

本ポリシーは、エイベックス・マネジメント株式会社（以下「当社」）が、本ウェブサイト上で提供するサービスにおけるお客様の個人データの処理に適用されます。本ポリシーの定めが、当社のプライバシーポリシー（https://avex.com/jp/ja/public/privacy/）の定めと矛盾する場合には、矛盾する限りにおいて、本ポリシーの定めが優先するものとします。

2. 定義

本ポリシーにおいて、

(a) 「個人データ」とは、識別された又は識別可能な自然人に関する情報をいいます。

(b) 「関係会社」とは、当社ウェブサイト（https://avex.com/jp/ja/corp/officer/#sec02）の「グループ会社一覧」に記載されている会社をいいます。

3. お客様の個人データの収集方法

当社は、ウェブサイト上のフォーム、メール、手紙等の手段にかかわらず、お客様が当社に提供する、お客様の氏名、住所、ニックネーム、メールアドレス、電話番号、生年月日、性別、国籍、お問い合わせ内容、自己紹介、プロフィール写真、クレジットカード情報等の情報を収集することがあります。

また、当社は、販売プラットフォーム（Merchbar）から、お客様の氏名、住所、電話番号、メールアドレス等の提供を受けることがあります。

お客様が当社のウェブサイトをご覧になる際、当社は、お客様のクッキーを自動的に収集することがあります。

4. 個人データの処理目的

当社は、お客様に関して保有する個人データを以下の目的で使用します。当社は、これらの目的を達成するために必要な範囲内に限ってお客様の個人データを使用します。

(a) メルマガの配信

(b) お客様のご関心の分析

(d) お客様へのファンクラブサービスの提供

(e) お客様がご購入された商品の配送

(f) お客様がご購入された商品に関するカスタマーサポートの提供

5. 取得者への個人データの開示・共同利用

当社は、お客様の個人データを以下の類型の受領者と共有することがあります。

(a) 関係会社　当社は、お客様の個人データを関係会社に開示することがあります。

日本法の下では、個人情報保護法上の共同利用の枠組みを用いて関係会社との間で、上記の第3項に記載の個人データ（当社が販売プラットフォームから提供を受ける個人データを除く）を、上記の第4項(a)～(d)に記載の目的で、共有することがあります。この場合、当社が個人データの管理について責任を負う者となります。「関係会社」の範囲については上記の第2項を、当社の住所及び代表者の氏名等につきましては下記の第9項をご参照下さい。

(b) 従業員　当社は、個人データにアクセスする権限及び必要性を有する当社の従業員に対して個人データを開示することがあります。

6. 個人データの保管期限

当社は、収集した個人データを、当該個人データの処理のために必要な期間保持するものとします。例えば、メルマガを配信するために処理する個人データは、お客様がメルマガ会員を退会されてから1ヶ月間保持します。ただし、個人データをより長い期間保持することが法令により要求されている場合はこの限りでなく、この場合には、当該個人データを法令により要求される期間保持するものとします。

7. お客様の権利

お客様は、当社がお客様に関して保有する個人データについて、複数の法的権利を有しています。これらの権利は、お客様の所在地及びお客様と当社の関係に適用されるデータ保護法令に応じて変わり得るものですが、典型的には以下のものが含まれます。

(a) お客様に係る個人データの処理に関する情報を取得する権利、及びお客様に関して当社が保有している個人データにアクセスする権利

(b) お客様の個人データが不正確又は不完全である場合に、当社に対して訂正を要求する権利

(d) 特定の状況において、当社による個人データの処理を制限することを当社に対して要求する権利

(e) お客様の個人データの処理に関して、当社に対し異議を述べる権利

(f) 構造化され、一般的に利用され機械可読性のある形式で個人データを受け取ること、及び/又は、当社が、技術的に実行可能な範囲で受領者に対してその個人データを直接移転することを要求する権利

(g) お客様の個人データの処理に関する同意をいつでも撤回する権利

お客様は、下記の第9項に記載する当社の連絡先に連絡することにより、権利を行使することができます。当社により権利が侵害されたと考える場合には、データ保護当局に苦情を申し立てることも可能です。

8. 安全管理措置

当社は、個人データの処理規程を策定するほか、個人データの処理状況の定期的な自己点検、個人データの処理に関する従業者への定期的な研修、個人データを処理する機器の盗難・紛失防止、アクセス制御の実施等、処理する個人データの漏洩、滅失又は毀損の防止その他の個人情報の安全管理のために必要かつ適切な措置を講じています。また、当社は、個人データを処理する委託先及び従業員に対して適切な監督を実施しています。

下記の第9項に記載する当社の連絡先に連絡することにより、当社が個人データの処理に関して講じている安全管理措置について更なる詳細を確認することができます。

This policy applies to the Processing of your Personal Data by Avex Management Inc. (“we”, “us,” and “our”) in the services provided on this website. In the event of any inconsistency between the provisions of this Policy and the provisions of our Privacy Policy (https://avex.com/jp/en/public/privacy/), the provisions of this Policy shall prevail to the extent of the inconsistency.

2. Definitions

In this Policy:

(a) “Personal Data” means any information relating to an identified or identifiable natural person;

(b) “Affiliates” means the companies listed in the "Group companies" section of our website (https://avex.com/jp/en/corp/officer/); and

(c) “Process/Processing” means any activity or operation that is carried out in respect of the Personal Data, such as collecting, storing, using, transferring, or deleting it.

3. How we collect your Personal Data and what Personal Data we collect

We may collect information that you provide to us, whether by means of a form on our website, by email, in a letter, or otherwise, such as your name, address, nickname, email address, telephone number, date of birth, gender, nationality, details of your inquiry, your self-description, profile photo, and credit card details.

We may receive your name, address, telephone number, email address, and other information from the sales platform(Merchbar).

We also may automatically collect your cookies when you visit our website.

4. Purpose of Processing Personal Data

We use the Personal Data that we hold about you for the following purposes. We will use your Personal Data only to the extent that it is necessary to do so to fulfill the purposes described below.

(a) to send you our email newsletter;

(b) to analyse your interests;

(d) to provide you with our fan club services;

(e) to deliver products you have purchased;

Under Japanese law, we may share your Personal Data, as referenced in Section 3 above (excluding Personal Data that we receive from sales platforms), with our Affiliates in the framework of joint use under the Personal Data Protection Act, for the purposes referred to in Section 4 (a) to (d) above. In this case, we will be the party responsible for the management of your Personal Data. Please refer to Section 2 above for the scope of "Affiliates" and to Section 9 below for our address and the name of our representative.

(b) Our employees: We may disclose your Personal Data to our employees who have the authority and need to access it; and

(c) Service providers: We may disclose your Personal Data to service providers, such as music producing companies, record companies, delivery companies, and IT service providers.

6. Storage period for Personal Data

We will retain your Personal Data that we collect for the period necessary to Process such Personal Data. For example, Personal Data Processed for the purpose of sending you the email newsletter will be retained until one month after you have cancelled your membership to the newsletter. However, this does not apply if we are required by law to retain your Personal Data for a longer period of time, in which case, we will retain it for the period required by law.

7. Your rights

You have a number of legal rights in relation to the Personal Data that we hold about you. These rights may vary depending on where you are located and which data protection laws apply to the relationship between you and us, but typically will include the following:

We take all necessary and appropriate security control measures, including measures to prevent the leakage, loss, or damage of Personal Data to be Processed, such as establishing rules for the Processing of Personal Data, regular self-inspection of the Processing of Personal Data, regular training of employees in the Processing of Personal Data, prevention of theft or loss of equipment Processing Personal Data, and implementation of access controls. We also exercise appropriate supervision over our contractors and employees who Process Personal Data.
